An Arkansas Circuit Court Judge rules that a long standing system for charging jail inmates is constitutional in Marion County but finds issues with the application of the law.
In a recap of the ruling from KTLO, Circuit Judge John Putman cited the number of rulings that allow counties to charge inmates for housing during incarceration however he did point out that some of the procedures in place in Marion County by ordinance were not followed.
An inmate, Nicholas Steven Jackson, had filed a lawsuit challenging the constitutionality of the system and the nearly $19,000 that were incurred due to his time in the Marion County Jail. The KTLO Recap says that Putman indicated some of the process to determine Jackson's ability to pay did not happen. As part of this ruling, Putman struck down the amount Jackson owed the county.
